Obvious n00b question but I don't want to get scammed out of billions. When paying the ISK to the character you are buying do you send it as a gift or contract?
Since it appears that this is the only official marketplace for characters do I have protection? Like if I send the ISK and don't hear anything back can I file a petition?

Yeah I have read that, thanks for the link. That document does not state how to send the ISK, by Gift or Contract.
Now back to my original question.

For the character you wish to purchase, right click on the name and "give money". When the character you're purchasing receives the isk, they should then send you an eve mail or tell you here in the forums that they've gotten the isk and that they are initiating transfer of the character to you. You should document all transactions through eve mail and here on the forum (i.e. when you give isk, when the character was sent/received, etc...). This will give CCP "documentation" they need in order to speed up resolution of any issues.
It's not a bad idea to strike up a conversation in game first before purchasing the character so you can get a little background. But as soon as you are ready to transfer isk, start using eve mail and the forum to document the transaction. Make sure you both agree on the price and any other considerations via eve mail and the forums. If something goes wrong, when you file a petition, you will have documentation. I personally use eve mail extensively when buying/selling characters as I can keep the eve mails for later.

@Evil McBadChick ~ Thank you kindly. That's the exact type of info I was hoping for. I do believe one should be safe and document the transaction after taking many many months earning the ISK to buy another character. Would suck getting ripped off but since this is the only official place to do it, appears reasonable safe, your advice duly noted. Thanks.
