1st, who made you the internet copyright police. 2nd, it's been going since 2007, devs have most likely seen it already and if anyone has a say it would be CCP. Not some forum warrior in the general section of the forums.

I have heard of copyright infringement before but never illegal downloading. Is that what you do when you download something without asking if you can have it first... Because in all cases of downloading I've heard of you actually send a request to the other computer to make a COPY of something and send it to you.
I would really like to see your solution on how to get something off another storage device without asking for it first. I believe it's called illegal sharing in that case. Which after all things considered still falls under copyright infringement...

I'm sure that CCP doesn't mind stuff like this being made and spread around by fans. With proper copyright info and link back to their site ofc.
Otherwise they wouldn't post link to it on eveO page while Trinity was deployed and everything (with forums too) was offline.
Which resulted with my (former) server being shut down by hosting company during rest of the day, due to 400 gb of bandwith being sucked in less than 1 hr by community
Anyway, thanks for words of support, makes me more eager to finish v.3 \o/

Fair use is a provision in US copyright law. EVE is Iceland, OP is hosting in Croatia. US law doesn't apply. Croatian copyright law requires the creator of the flash game to notify CCP and have their permission to use their assets. For all we know, he did that and has it.
Either way, if you're worried about CCP's copyright, petition/contact them to notify them of a potential violation, don't go 'policing' on the forums. It just makes you look like an ass.

I think it's a shame that the game is so unreal. Here missing so many things that make EVE into what it is. To take just a few. There are no ninja Salvager. No Highsec ganker. None of the attempts to steal your booty. Last but not least delay is not noticeable. And where the **** are the disconnects?

Have you considered that someone might be saying that for his benefit, and not that of CCP per se? My first reaction was too: "Wow! Gorgeous! But is it legal? He could find himself in a lot of trouble over it." Reread the Terms of Service, and you'll find that you're expressly forbidden to create EVE emulators and such. Has got nothing to do with Iceland Law or US Law or whatever: the TOS is simply a form of contract you agreed to abide by when you signed up for the game. Violate that, and CCP may simply ban him.
And, before you ask, I think going after this guy, or anyone who makes fanvids and such, is generally just plain stupid: in monetary sense you gain zilch, and you only lose a lot of public goodwill. But warning him about the possible consequences, I still see nothing wrong with that.

CCP is well aware of this so called game, it's been online since 2007, and they even published it on www.eveonline.com during Trinity deployment.
I also created other stuff: Pos Defense, Wheel of whineage, Battle simulator, and "Character creator"
All above was posted here, and I'm sure that if those were against they wishes, I would already have been warned.

Doesn't that also affect the creator? Because maybe there are no copyright rules in the country where the guy that made this is from?
That's also why here in Holland (or The Netherlands) we can just run to the police office and scream ''I JUST DOWNLOADAD AVATAR FROM PIRATEBY!!1111!!'' and they will just look at you and be like ''So???'' (We can download everything legaly but we can't make any profit from it)
