Well what about pirates? They don't even ask if you want to get popped, they just shoot at you. But the same principle applies - You jumped into low sec, so you set yourself up for it, just like you clicked the contract, clicked a second time to accept the contract, and clicked a THIRD time to accept the warning that says "You're going to be giving X and receiving Y, are you sure this is right?".

People being stupid and falling for scams doesn't remove the fact that a scam is a scam.
Scam: Fraudulent deal; To defraud or embezzle.
All this contracts are based on the other part not noticing the real deal. Even if the real deal is stated there, the victim accepts it believing that you are offering another thing and you set up the contract to make him think that he is going to receive something different than what the contract offers. So yes, making contracts to cheat on people is scamming no matter what.
Discussing where is the line does not matters here, because this actions are well behind the line. Arguing that it is difficult to set the line does not remove the existence of the line.
And... guess what? People around here doesn't like scammers... maybe because they tend to not return your money back. Twisting reality and justifying fraud actions is even worse, because those people tend to decide one day that they have the right to own your money for whatever reason they like (may be a sick son, world's justice or a crashed computer).

Scam is scam, there is no such thing as just a small scam. If you can mislead and cheat one part, what stops you form misleading and cheating another part? (read; investor)

It appears that RaWBLooD has a sufficiently long contract history that his more recent contracts might not be displayed properly, and the quoted chat log does not specify what pilot might have done the transaction anyhow, if it did occur. So if there is evidence, it might not be readily ascertainable.
While I have seen no evidence (aside from his own claim at one time) that that he did purposefully mis-describe a contract, I also have no evidence (aside from his own claim at another time) that he didn't. So the evidence is inconclusive about whether he scammed. What is clear is that he is not truthful 100% of the time, but that's not very damning, since few people are. a a

Maths does not equal language. A double negative in language is a tricky beast and need not straightforwardly and simply convert into a positive, partly because there are at least two types of positives. It's not the case that none of the people here are scammers might convert to either all the people here are scammers or to some of the people being scammers. But also, more importantly, to say something like "It's not unlucky" is not necessarily the same as to say "It is lucky" because "not unlucky" can be construed in a variety of ways (one might for instance deny that there is any such thing as luck).

During a lecture the Oxford linguistic philosopher J. L. Austin made the claim that although a double negative in English implies a positive meaning, there is no language in which a double positive implies a negative.
