edit: background: I was on evewiki, looked up jump freighters, said they could use jump gates, looked up jump gates, didn't say there (afaik) what kind of ships were able to use them

Everything except ship requiring the 'capital ship' skill
Not allowed: -titan -mothership -carrier -dreadnough -rorqual
Allowed: everything else including freighter and jump freighter

This is correct, you have to remember that freighters and jump freighters are not capital ships because they do not require the capital ship skill to fly them. |

to the quote above the devs have already said in the old thread about the orca that the capital skill has nothing to do with being able to use a gate or not |

This. There's an attribute called canNotUseStargates that blocks a ship from using gates.

However, at the moment, all ship with canNotUseStargates require the capital ship skill, and all ship wich require the capital ship skill have the canNotUseStargates bit set.
Since the prerequisites skills are easy to check ingame, and the canNotUseStargates bit is not, i used it in my answer.
But yes, to be absolutely correct, a ship cannot use stargate if canNotUseStargates is set.

definition of what is a capital ship depend on how you look: -need capital ship skill -need capital ship construction skill/capitals parts to be build

This is true, but you can't see the attribute, and even though from a programming perspective they are separate, the in-game reality is if it requires that skill, it can't use gates, if it doesn't it can. So this method is fine unless they ever release a ships that can use the skill and not gates or vice versa.
